Public Offer for Paid Services Agreement
1. General Provisions
1.1. This document constitutes a public offer in accordance with Article 437 of the Civil Code of the Russian Federation (hereinafter referred to as the "Offer") and is addressed to any capable person wishing to use NeuroVerdict (hereinafter referred to as the "Service").
1.2. The owner of the Service (hereinafter referred to as the "Operator") publishes this Offer on the website https://neuroverdict.com. Acceptance of the Offer is deemed to be the User's registration in the Service and/or payment for paid plans.
1.3. Upon acceptance of the Offer, a paid services agreement (hereinafter referred to as the "Agreement") is concluded between the Operator and the person who accepted the Offer (hereinafter referred to as the "User").
2. Definitions
2.1. Operator — the person holding rights to the Service and providing Services under this Offer. The Operator's details are specified in Section 11.
2.2. User — a person who has accepted the terms of the Offer by registering and/or paying for Services.
2.3. Service — the website https://neuroverdict.com and associated software providing access to search and query processing using external AI models.
2.4. Services — providing the User with access to the Service's functionality in accordance with the selected plan.
3. Subject of the Agreement
3.1. The Operator undertakes to provide the User with access to the Service and its functionality, and the User undertakes to use the Service in accordance with the Offer and to pay for Services when using paid plans.
3.2. The specific scope, cost, duration of Services, and quotas included in plans are specified in the plan descriptions on the Pricing page.
4. Registration and User Account
4.1. To access the Service's functionality, the User authorizes through external OAuth providers (Google, VK ID, Telegram) or uses anonymous mode.
4.2. The Service does not store user passwords. Authorization is performed through secure protocols of external providers.
4.3. The User is responsible for all actions performed under their account.
4.4. The User may delete their account and all associated data through the profile page.
5. Service Delivery Procedure
5.1. Services are provided automatically using the Operator's software and external API providers (suppliers of AI models and infrastructure).
5.2. The Service is not a mass media outlet, a source of official consultations, or expert opinions. AI model responses are of an informational and reference nature.
5.3. The User independently evaluates the accuracy and applicability of the results obtained and bears the risks associated with decisions made based on them.
6. Pricing and Payments
6.1. Current pricing information and included query volumes are published on the Pricing page. The Operator reserves the right to change prices and quotas unilaterally by posting updated information on the website.
6.2. Payment for Services is made by non-cash transfer through a payment provider selected by the Operator. The Operator does not store User bank card details.
6.3. Refunds are made in cases and in the manner provided for by the legislation of the Russian Federation and the payment provider's rules.
7. Rights and Obligations of the Parties
7.1. The Operator undertakes to:
- maintain the operability of the Service except during maintenance and force majeure circumstances;
- process User personal data in accordance with the Privacy Policy.
7.2. The User undertakes to:
- not disrupt the operability of the Service and not attempt unauthorized access;
- not use the Service for unlawful activities or for distributing prohibited information;
- pay for Services in a timely manner under the selected plan.
8. Limitation of Liability
8.1. The Service is provided on an "as is" basis. The Operator does not guarantee error-free operation of the Service, nor absolute accuracy and completeness of the answers provided.
8.2. The Operator shall not be liable for direct or indirect damages of the User resulting from the use or inability to use the Service, except in cases expressly provided for by the legislation of the Russian Federation.
9. Term and Amendment of the Offer
9.1. The Offer takes effect from the moment of its publication on the website and remains in effect until withdrawn by the Operator.
9.2. The Operator reserves the right to amend the terms of the Offer unilaterally. The new version takes effect upon publication unless a different date is specified.
10. Dispute Resolution Procedure
10.1. Disputes and disagreements arising in connection with the execution of this Agreement shall be resolved through negotiations and exchange of claims via email.
10.2. If no agreement is reached, the dispute shall be submitted to a court at the Operator's location in accordance with the applicable legislation of the Russian Federation.
